NOTICE OF YOUR FINANCIAL PRIVACY RIGHTS

At Sutton Bank, we believe that your privacy should not be compromised. You can count on our belief that Old Fashioned Innovation will provide you with the services you want, need, and deserve to accomplish your financial goals. This is our privacy notice to our customers. We, our, and us will refer to Sutton Bank. You and your means all consumer customers who have a continuing relationship with us through products such as: Deposit and Loan accounts, Credit Card account, Safe deposit box, Retail installment contract we hold and service, Individual Retirement Account where we act as custodian, certificates of deposit, and former customers. You and your also refers to any consumer that uses a bank service but does not have a continuing relationship. These services would include ATM transactions and loan applicants that are denied. Nonpublic Personal Information is personally identifiable financial information that is collected but is not readily available from public sources such as telephone directories or government agencies. Affiliate is any company we own, control, or who owns or controls us.Nonaffiliated Third Party is any company that is not an affiliate.

The Information We Collect
We collect nonpublic personal information about you from the following sources:
• From applications and other forms such as your name, address, social security number, income;
• From your transactions with us or others such as your account balance and credit card usage;
• From a consumer reporting agency (a Credit Bureau) such as your credit history.

Information Disclosure
We may disclose all of the information we collect (as described above) to companies that perform marketing services on our behalf or to other financial institutions with which we have joint marketing agreements. We do not disclose any other nonpublic personal information about our customers to any nonaffiliated third parties, except as permitted by law. If you close all of your account(s) and become a former customer, we protect you privacy as if you were a current customer.

Confidentiality and Security
We restrict access to your nonpublic personal information to those employees who need to know that information and provide products or services to you. We maintain physical, electronic, and procedural safeguards to protect this information. Our employees uphold and understand the importance of maintaining the confidentiality of customer information.


Customer Identification Program
IMPORTANT INFORMATION ABOUT PROCEDURES FOR OPENING A NEW ACCOUNT:
To help the government fight the funding of terrorism and money laundering activities, Federal law requires all financial institutions to obtain, verify, and record information that identifies each person who opens an account. What this means for you: When you open an account, we will ask for your name, address, date of birth, and other information that will allow us to identify you. We may also ask to see your driver's license or other identifying documents.

TERMS AND CONDITIONS

These Dollar Card Terms and Conditions (“Terms and Conditions”) set forth the terms and conditions under which you may use the Dollar Card to obtain cash goods, and services through automated-teller-machine (“ATM”) and point-of-sale (“POS”) transactions. The Dollar Card is issued to you by Sutton Bank (also referred to in these Terms and Conditions as the “Bank,” “we,” or “us”). In these terms and conditions, the words “you” and “your” refer to the person to whom the Dollar Card is issued and any other person you’ve authorized to use the Dollar Card. The Dollar Card will be issued to you by the Bank upon completion of your application for the Dollar Card. You must sign the Dollar Card before using it. By receiving and using the Dollar Card, you agree with the Bank that the Dollar Card, and the money or funds stored on the Dollar Card, are subject to these Terms and Conditions.

The Dollar Card is only offered to individuals over the age of 18 who can lawfully enter into and form contracts under applicable law; by applying for or using the Dollar Card, you represent and warrant to the Bank that you are such an individual. The Bank in its sole discretion may refuse to issue the Dollar Card to anyone for any reason.

The Dollar Card is offered to you through Cash Benefits, Inc.. Cash Benefits, Inc. is not the issuer of the Dollar Card, and is not responsible for your Dollar Card or for your use of it.

1. Your Dollar Card and Loading Value on the Card.

The Dollar Card is a prepaid debit card and is an access device for a joint deposit account (with appropriate sub-accounting measures) that is established for you at the Bank. This account is a limited purpose, virtual checking account at the Bank in which the funds to be accessed by the Dollar Card are maintained. You have no rights with those funds, except to access the funds through the Dollar Card in accordance with these Terms and Conditions.

You may only access the funds in this stored-value account with your Dollar Card in accordance with these Terms and Conditions. You may not make any deposit, withdrawal, or any other transaction with the Dollar Card or the account, except for the Dollar Card transactions described in these Terms and Conditions.

The funds stored on the Dollar Card or in the Bank's related stored-value account are FDIC-insured.

To obtain the Dollar Card, you must have previously agreed with Cash Benefits, Inc. and your employer to receive all or a portion of your payroll by means of funds loaded onto the Dollar Card. Cash Benefits, Inc. is responsible for instructing the Bank to load the amount of funds designated by Cash Benefits, Inc. onto the Dollar Card as agreed. Once the funds are loaded onto the Dollar Card, the funds belong to you, and you may use the Dollar Card for the types of transactions described in these Terms and Conditions. These funds are available for your withdrawal as provided in these Terms and Conditions by the close of business on the day we receive the funds from Cash Benefits, Inc.. If the day on which we receive the funds from Cash Benefits, Inc. is not a business day for us, the funds will be available to you by the opening of business on the next business day. For purposes of these Terms and Conditions; our business days exclude Saturdays, Sundays, and federal holidays.

The Bank does not pay any interest on the funds in the Dollar Card account. The Dollar Card has no minimum balance requirements.

The amount of funds shown on the Bank's records, and as stored on the Dollar Card, will determine the balance on the Dollar Card, unless you can support your dispute to our satisfaction.

You hereby authorize the Bank to deduct any applicable fees, as set forth and defined in these Terms and Conditions for your Dollar Card. There is no credit line associated with your Dollar Card. This means that you must have a sufficient balance of funds on the Dollar Card at the time of a transaction to pay for the transaction. If a merchant or an ATM operator attempts to submit a transaction on the Dollar Card for an amount that is greater than the current balance on your Dollar Card, the transaction may not be approved by the Bank. In the event that the Bank, in its sole discretion, settles or pays a transaction with your Dollar Card when there are insufficient funds stored on the Dollar Card to pay for the transaction, this will result in an overdraft on your Dollar Card. You agree to pay the Bank the amount of the overdraft and any related fee. We may deduct the overdraft amount and related fee from your Dollar Card.

2. Funds Availability.

Funds deposited in the Bank for credit to your Dollar Card are available on the following schedule:

As described in Section 1 from Cash Benefits, Inc.. For electronic deposits made from other bank accounts the following business day we receive funds.

3. Your Personal Identification Number/Signature on the Dollar Card.

To protect the use of your Dollar Card for ATM transactions, a personal identification number (“PIN”) will be required to conduct a transaction with your Dollar Card at ATMs. This PIN will be provided to you by the Bank at or around the time your Dollar Card is issued. You should not disclose your PIN to anyone. If the security or confidentiality of your PIN is compromised, you should notify the Bank at once. You are liable for any transactions made by a person you authorize or permit to use your Dollar Card and/or PIN. If you permit someone else to use your Dollar Card, we will treat this as if you have authorized this person to use your Dollar Card and you will be responsible for any transactions initiated by such person with your Dollar Card or Dollar Card number.

There is a panel on the back of the Dollar Card for your signature. You should sign this panel as soon as you receive your Dollar Card because it helps protect your Dollar Card from unauthorized use. However, your responsibility for Dollar Card transactions, as described in these Terms and Conditions, does not depend on whether you sign your Dollar Card.

4. Role of Cash Benefits, Inc..

Cash Benefits, Inc. is responsible for transferring funds to the Bank to fund your Dollar Card account. Those funds will be transferred by Cash Benefits, Inc. to the Bank and deposited into your Dollar Card account by the Bank according to the schedule agreed to by Cash Benefits, Inc. and the Bank. The Bank has no obligation to you in the event Cash Benefits, Inc. delays in providing, or fails to provide, funds to your Dollar Card account.

Cash Benefits, Inc. may retain the right to deduct funds stored on the Dollar Card to correct a previous error or overpayment to you or for other reasons. You hereby authorize the Bank to accept instructions from Cash Benefits, Inc. to add or deduct funds from your Dollar Card account, or in the case of a deduction to return those funds to Cash Benefits, Inc.. If you have a dispute with Cash Benefits, Inc. about the amount of your payroll proceeds, or the amount that Cash Benefits, Inc. loads onto or deducts from the Dollar Card account, you agree to not involve the Bank in the dispute and to resolve the dispute solely with Cash Benefits, Inc..

5. Transactions with Your Dollar Card.

Your Dollar Card may be used to access the funds stored in your Dollar Card Account. Provided that funds are available in your Dollar Card account, you may use your Card to perform the following types of transactions in accordance with these Terms and Conditions:

a. At any ATM displaying the STAR or Cirrus logos, you may use your Dollar Card (subject to the transaction limits specified in Section 7 of these Terms and Conditions) to (I) make withdrawals of cash up to the amount of funds in your Dollar Card account, or to obtain Dollar Card account balance information. The Dollar Card can be used at ATMs within the United States and at international ATMs displaying the appropriate network identification. Some of these services may not be available at certain ATMs.

b. At any merchant location displaying the STAR, CIRRUS or MAESTRO logos, you may use your Dollar Card (subject to the transaction limits specified in Section 7 of these Terms and Conditions) to purchase goods and services (and obtain cash) up to the amount of funds in your Dollar Card account.
c. At any branch of the Bank, you may use your Dollar Card (subject to the transaction limits specified in Section 7 of these Terms and Conditions) to obtain cash up to the amount of funds in your Card account.

6. Fees and Charges for Use of the Dollar Card.

The Bank may change these fees in the future and will notify you beforehand.

Third-Party Fees

When you use an ATM not owned by the Bank, you may be charged a fee by the ATM operator or any network used. (You may also be charged a fee for a balance inquiry even if you do not complete a fund transfer at the ATM.) In addition, you may be charged fees by other third parties for use of your Dollar Card, such as (I) stores and merchants for POS transactions, and (ii) other banks and financial institutions for cash withdrawals at their branches.

7. Daily Transaction Limits.

The following daily withdrawal and purchasing limits will apply to your use of your Dollar Card:

• $500.00 withdrawal limit per day, three transactions per day at any ATM that accepts the Dollar Card, or at any Bank branch.

• $1,500.00 purchase limit per day at any merchant that accepts the Dollar Card.

8. Foreign-Currency Transactions.

If you make a transaction in currency other than U.S. dollars STAR, Cirrus, or Maestro (the network) will convert the debit or credit into a U.S.-dollar amount. The conversion rate will be determined using the network currency-conversion procedures then in effect. The conversion rate on the processing date may differ from the rate on the date of your transaction. Currently, the network uses a currency conversion rate of either a wholesale market rate or a government-mandated rate, increased by all adjustment factor determined by it. In each case, the network uses the rate in effect one day before the conversion date. The adjustment factor, which is subject to change without notice, is currently 3% of the U.S.-dollar amount, of which we receive 2% and the network receives the remainder. We will post the converted U.S.-dollar amount determined by the network, as described above, to your Dollar Card account.

9. Documentation of Dollar Card Transactions.

You will receive the following documentation with your Dollar Card transactions:

a. At the time you make a Dollar Card ATM transaction or merchant POS transaction, you will obtain a receipt for the transaction.

b. Each month in which you Dollar Card is used to conduct a withdrawal or other transfer, you will receive either a monthly paper statement or an electronic mail notifying you of the on-line availability of your electronic statement showing all debits and credits posted to your Dollar Card that month. If you do not consent to receiving statements and disclosures electronically as provided in section 24 of these Terms and Conditions, you will be charged a fee for mailing a paper statement as indicated in Section 6.

In addition, you can determine the balance of funds available in your Dollar Card account (I) at any ATM displaying the STAR or Cirrus logos, (ii) by calling 866-261-2587, or (iii) via the Internet at WWW.CASHBENEFITSINC.COM. You also can call us at to find out whether payroll or other proceeds have been deposited into your Dollar Card account.

10. Disputes with Merchants.

If you use your Dollar Card at a merchant and a dispute with the merchant arises, you agree to make a good-faith effort to settle the dispute with the merchant. Any unresolved dispute may be sent to us in writing for assistance in settlement. Except as expressly provided for preauthorized payments in these Terms and Conditions, you cannot stop payment to merchants for transactions made with your Dollar Card.


11. Preauthorized Payments.

If you have authorized a merchant to initiate debits to your Dollar Card account at regular intervals, you can stop any of these payments. Here's how:

Call us at 866-261-2587, or write to us at P.O. Box 505, Attica, OH, 44807, in time for its to receive your request three (3) business days or more before the payment is scheduled to be made. If you call, we may also require you to put your request in writing and get it to us within fourteen (14) days after you call, (We will charge you $20.00 for each stop payment order you give.)

If you order us to stop one of these payments three business days or more before the transfer is scheduled, and we do not do so, we will be liable for your losses or damages.

12. Confidentiality of Information on Your Dollar Card.

The Bank's privacy policy sets forth how the Bank treats and protects your personal information, which it obtains under these Terms and Conditions and by means of providing the Dollar Card services to you. The Bank will provide you with a copy of the privacy policy when the Dollar Card is issued to you. You should review this privacy policy and retain a copy of it for your records.

13. Your Card-Use Liability.

Contact us IMMEDIATELY if you believe your Dollar Card has been lost or stolen. Telephoning is the best way of keeping any losses to a minimum. You could lose all the money stored on your Dollar Card. If your Dollar Card is used in connection with an unauthorized transaction that was processed through the STAR, Cirrus, or Maestro Network, your liability for such unauthorized use will not exceed $0 if (I) you reported the loss or theft of your Dollar Card to the Bank, and (ii) you did not act grossly negligently or fraudulently in handling your Dollar Card.

For all other transactions with your Dollar Card, if you tell us within two business days, you can lose no more than $50 if someone used your Dollar Card without your permission. (If you believe your Dollar Card has been lost or stolen, and you tell us within two business days after you learn of the loss or theft, you can lose no more than $50 if someone used your Dollar Card without your permission.) If you do NOT tell us within two business days after you learn of the loss or theft of your Dollar Card, and we can prove we could have stopped someone from using your Dollar Card without your permission if you had told us, you could lose as much as $500.

Also, if your statement shows Dollar Card transactions that you did not make, tell us at once. If you do not tell us within 60 days after receipt of the electronic mail notifying you the statement was available for viewing at the CASH BENEFITS, INC. website, you may not get back any of the money you lost after the 60 days if we can prove that we could have stopped someone from taking the money had you told us in time.

If a good reason (such as a long trip or a hospital stay) kept you from telling us, we will extend the time periods.

14. Bank Liability.

If the Bank does not complete a transfer to or from your Dollar Card account on time or in the correct amount according to these Terms and Conditions, we will be liable for your losses or damages, subject to the following exceptions. The Bank will not be liable:

(1) If, through no fault of ours, you do not have enough money in your Dollar Card account to make the
transaction.

(2) If the ATM where you are making the Dollar Card transaction does not have enough cash.

(3) If the terminal or system was not working properly and you knew about the breakdown when you started
the Dollar Card transaction.

(4) If we are prohibited by law from completing the transaction.

(5) If circumstances beyond our control (such as fire or flood) prevent the Dollar Card transaction, despite
reasonable precautions that we have taken.

15. Disclaimer of Liability.

In providing the Dollar Card and related services to you, the Bank disclaims any duty or responsibility other than those expressly set forth in these Terms and Conditions.

16. Bank Right of Set-Off.

You agree that the Bank is authorized at any time to set-off the funds deposited into your Dollar Card account against your debts or liabilities owed to the Bank. The Bank may exercise this right of set-off without notice to you.

17. Dormant Card Accounts.

You acknowledge and agree that the Bank may be required by applicable law to turn over to a state government authority any funds remaining on your Dollar Card account after a period of inactivity or dormancy.

18. Termination.

The Dollar Card shall remain the property of the Bank, and you agree upon demand to return your Dollar Card to the Bank. At any time and without prior notice, the Bank may revoke or cancel your Dollar Card and thereby terminate these Terms and Conditions and demand return of your Dollar Card. You may terminate these Terms and Conditions at any time by returning your Dollar Card to the Bank. Termination whether by you or by the Bank, shall not affect prior transactions or obligations relating to your Dollar Card existing at the time of termination. Upon termination, the Bank will arrange to transfer any remaining funds stored on the Dollar Card to you.

19. Amendment.

We may amend these Terms and Conditions by delivering notice of the amendment to you in the manner agreed to by you and the Bank, or to your last electronic address as shown on the records of the Bank. You will be given at least 21 days' notice prior to the effective date of any amendment that results in an increased fee or charge, an increase in your liability, a reduction in services offered by the Bank, or stricter limitations on transaction or withdrawal rights.

20. Assignment.

You may nor transfer or assign these Terms and Conditions to any other person without the Bank's prior written consent. We may assign our obligations to you under these Terms and Conditions without your consent or any prior notice.

21. Severability/No Waiver.

If any provision of these Terms and Conditions shall be deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and Conditions and shall not affect the validity and enforceability of any remaining provisions. The Bank's failure to enforce the strict performance of any provision of these Terms and Conditions will not constitute a waiver of the Bank's right to subsequently enforce such provision or any other provisions of these Terms and Conditions.

22. Governing Law.

These Terms and Conditions, the Dollar Card, and all transactions hereunder are subject to the laws of the state of Ohio and the laws of the United States of America.

23. Notice of Errors.

In case of errors or questions about your Dollar Card transactions, telephone us at 1-866-261-2587,or write us at 1 South Main Street, Attica, OH 44807.

If you think your statement or receipt is wrong, or if you need more information about a Dollar Card transaction listed on the statement or receipt, notify us as soon as possible. We must hear from you no later than 60 days after we sent the FIRST statement on which file problem or error appeared.

(1) Tell us your name and Dollar Card number.

(2) Describe the error or the transfer you are unsure about, and explain as clearly as you can why you believe it is all error or why you need more information.

(3) Tell us the dollar amount of the suspected error.

If you tell us verbally, we may require that you send us your complaint or question in writing within ten business days.

We will determine whether an error occurred within ten business days after we hear from you, and we will correct any error promptly. If we need more time, however, we may take up to 45 days to investigate your complaint or question. If we decide to do this, we will credit your Dollar Card account (within ten business days) for the amount you think is in error, so that you will have the use of the money during the time it takes us to complete our investigation. If we ask you to put your complaint or question in writing, and if we do not receive it within ten business days, we may not credit your Dollar Card account.

For errors involving new Dollar Cards and point-of-sale or foreign-initiated transactions, we may take up to 90 days to investigate your complaint or question. For new Dollar Cards, we may take up to 20 business days to credit your Dollar Card account for the amount you think is in error.

We will tell you the results within three business days after completing our investigation. If we decide that there was no error, we will send you a written explanation. You may ask for copies of the documents that we used in our investigation.


24. Consent for Electronic Disclosures Initial here for consent ____________

By separately initialing this paragraph, you consent to having all disclosures provided or made available to you in electronic form and by doing business with Bank electronically, you also acknowledge that you can access the electronic disclosures in the designated format. Your consent applies to all of the documents we provide to electronically you in connection with the Dollar Card, including periodic statements, notices, disclosures, future amendments, correspondence and information.

If you consent to electronic delivery of documents, we are not required to provide you with paper copies. However, should you wish to obtain a paper copy of any of the disclosures, you may write to us at the address provided in Section 23 with the details of your request. A paper copy will be mailed to you for a fee as provided in Section 6. If you decide to withdraw your consent for electronic disclosures, you must notify us in writing at the address provided in Section 23 of these Terms and Conditions. Upon your withdrawal of consent, we will commence mailing you monthly statements for which a fee will be charged in accordance with Section 6.

It is your responsibility to update the information needed for us to contact you electronically in order for you to receive the disclosures covered by these Terms and Conditions. If your information needs to be updated; you must promptly notify us by contacting us at the address or telephone number provided in Section 23.

Electronic disclosures will be provided by way of the Internet. An electronic mail will be sent to the electronic mail address provided by you notifying you that the disclosures or your statement is available for viewing. In order to view these disclosures, you will need a hardware device that can access the Internet via modem or other form of connection. Your hardware device must run on an appropriate operating system. You must be able to access the Internet to access our website. Additionally, Internet browser software is required to access the disclosures from a personal computer (Internet Explorer 4.0 or above, Netscape Navigator 4.0 or above or equivalent software). You may retain electronic messages for your records in paper form by printing a copy using the print function of your software.

By physically signing these Terms and Conditions or authorizing your employer and Cash Benefits, Inc. to directly deposit your payroll proceeds with the Bank, you are (i) requesting that a Dollar Card and a PIN be issued to you, and (ii) agreeing to be bound by the terms and conditions of this agreement as it may be from time to time amended, modified, restated or otherwise changed. By initialing section 24 of these Terms and Conditions, you are consenting to the electronic delivery of disclosures, statements and other information.

Your signature or authorization is also your acknowledgment that you have received a copy of these Terms and Conditions in either paper or electronic form and that you have read and understand this agreement. Thank you for your usage of the Cash Benefits, Inc. and Sutton Bank.
